Terms of Use

These Terms of Use apply to the MinuteTaker app, the website, and related online features. The provider is Florian Mielke, Bleicherwiesen 14, 31224 Peine, Germany.

1. Scope

These Terms govern the use of MinuteTaker, the website, and online features. Apple's terms and your Apple account settings also apply to App Store downloads, in-app purchases, subscriptions, refunds, and family sharing. If MinuteTaker is obtained through the App Store and no separate license agreement is provided, Apple's Standard EULA applies to the app license.

2. Business Use

You may use MinuteTaker for business purposes. If you use MinuteTaker for an organization, employer, customer, or client, you must be authorized to do so and ensure that submitted content may be processed lawfully.

Where an organization is the controller of meeting or transcript content and MinuteTaker processes that content on behalf of that organization through the MinuteTaker API, a data processing agreement may be required. In that case, a DPA or corresponding business terms must be agreed before the relevant use to the extent legally required. Florian Mielke may make use of the relevant online feature conditional on entering into a DPA.

3. MinuteTaker And License

MinuteTaker is an app for creating, structuring, and sharing meeting notes and minutes. The app stores most content locally on your device or in Apple synchronization services if you use them.

These Terms supplement the applicable App Store and license terms, especially for the website, online features, AI summaries, quotas, support, and acceptable use.

4. Your Content

Your content remains your content. You are responsible for minutes, transcripts, people, attachments, exports, and other content you create, import, edit, submit, or share in MinuteTaker.

Where an online feature requires it, your content may be processed to provide the requested feature. This applies in particular to transcripts you send to the MinuteTaker API for AI summaries.

5. AI Summaries

MinuteTaker can convert transcripts into structured meeting notes with AI. When you use this feature, the app sends the selected transcript text and optional context data to the MinuteTaker API. The API processes this data with OpenAI and returns the result to the app.

You may submit only transcripts that you are allowed to use. This is especially important if a transcript contains personal data, confidential information, or content from other people. You are responsible for obtaining any required notices, consents, or other permissions from meeting participants.

AI summaries may be incomplete, inaccurate, or misleading. Review every AI summary before using it, sharing it, or relying on it for decisions. Do not use AI summaries as the sole basis for legal, medical, financial, or similarly significant decisions.

6. Quotas

AI summaries may be limited by free trial quotas, subscription quotas, or technical limits. The available quotas are shown in the app or by the MinuteTaker API.

Florian Mielke may change quotas for future usage periods, in particular to prevent abuse, reflect costs, or develop the feature. Rights already acquired under an active subscription are not affected.

7. Acceptable Use

You may use MinuteTaker only lawfully. You may not misuse MinuteTaker, including by infringing third-party rights, processing unlawful content, bypassing technical protections or quotas, or disrupting the app, website, or MinuteTaker API.

9. Availability And Support

Florian Mielke operates MinuteTaker and the MinuteTaker API with reasonable care. Individual features may still be temporarily unavailable, for example because of maintenance, outages, App Store review, or third-party provider issues.

Support is offered on a best-effort basis. No specific response or resolution time is promised.

10. Changes

Florian Mielke may change, replace, or discontinue features when required for operation, security, compatibility, legal requirements, or product development.

Florian Mielke may update these Terms when MinuteTaker, service providers, or legal requirements change. The current version is published on this page.

11. Liability

Florian Mielke has unlimited liability for intent, gross negligence, and injury to life, body, or health.

For simple negligence, Florian Mielke is liable only for breach of essential contractual duties and limited to foreseeable damage typical for this type of contract. Essential contractual duties are duties that enable proper use of MinuteTaker and on which you may regularly rely.

12. Suspension And Termination

You may stop using MinuteTaker at any time and manage subscriptions through your Apple account. Florian Mielke may suspend or restrict access to online features if you breach these Terms, bypass quotas, misuse online features, or if your use endangers security, operation, third-party rights, or requirements of service providers used by MinuteTaker.

13. Applicable Law And Language

German law applies. If you are a consumer and mandatory consumer protection rules in your country of residence are more favorable, those rules also apply.

The German version is legally controlling. The English translation is provided for orientation.
